Form and Manner of Complaint

Kerala Lok Ayukta (Form and Manner of Complaint) Rules, 1999.

S.R.O. No. 152/99:- In exercise of the powers conferred by clause (c) of sub-section (2) of Section 22 of the Kerala Lok Ayukta ordinance, 1998 (Ordinance 16 of 1998), read with sub-section (2) of Section 9 thereof the Government of Kerala hereby make the following rules to prescribe the form in which complaints may be made under sub-section (1) of Section 9, of the said Ordinance, namely :-

1. Short title and commencement :- (1) These Rules may be called the Kerala Lok Ayukta (From and Manner of Complaint) Rules, 1999.

(2) They shall come into force at once.

2. Definition :- In these rules, unless the context otherwise requires :-

(a) "Ordinance" means the Kerala Lok Ayukta Ordinance, 1998 (Ordinance 16 of 1998);

(b) "Civil Rules of Practice" means the Civil Rules of Practice, Kerala, issued by the High Court of Kerala, to regulate the procedure and practice in the Subordinate Civil Courts in the State;

(c) "Complaint" means a complaint presented to the Lok Ayukta under Section 9 of the Ordinance;

(d) "Schedule" means the Schedule appended to these rules.

(2) Words and expressions used, but not defined, in these rules and defined in the Ordinance, shall have the meanings respectively assigned to them in the Ordinance.

3. Form of complaint :- Every complaint shall, as far as practicable be, accordance with the form set out in the Schedule.

4. Copies of complaint :- Every complaint and the documents accompanying it shall be in
quadruplicate, accompanied by as many number of spare copies as there are publicmen against whom
allegations of corruption have been made in the complaint.

5. Affidavit to accompany complaint :- Every complaint shall be supported by an affidavit by the
complainant as provided in sub-section (2) of section 9.

6. Contents of affidavit :- Every affidavit filed before the Lok Ayukta shall be drawn up and
authenticated in the manner (provided in) the Civil Rules of Practice, Kerala, for the time being in force.

7. Copies of documents to be relied upon :- If the complainant wants to rely upon any document shall along with the complaint submit under his signature, four copies of such document/documents accompanied by as many number of spare copies as there are publicmen against whom allegations of corruption have been made in the complaint.

8. Mode of presentation :- Every complaint shall be to the Lok Ayukta or Upa Lok Ayukta shall be filed before the Secretary of the Lok Ayukta or sent by registered post to the Secretary of the Lok Ayukta.

9. Defective complaint not to be entertained :- A complaint which does not comply with any of
requirements of the Ordinance or these rules shall not be entertained:

Provided that the complainant many be given an opportunity to cure the defects within such period in such manner, as may be specified by Lok Ayukta, or the Upa Lok Ayukta as the case may be.
