A
BILL
further
to amend the Kerala Lok Ayukta Act, 1999
Preamble:
WHEREAS it is expedient further to amend the Kerala Lok
Ayukta Act, 1999 for the purpose hereinafter appearing:
Be it enacted in the Fifty-second Year of the Republic of
India as follows:-
1.
Short title and commencement.- (1) This Act may be
called the Kerala Lok Ayukta (Amendment) Act,2001.

It shall come into force at once.

Amendment of section 22.- In section 22 of the Kerala
Lok Ayukta Act 1999 (8 of 1999), in sub-section (I), for
the words "other than a Government servant", the
words and figures 'other than a Government servant or a
last grade employee in the service or pay of any establishment
coming under items (A) to (F) of sub-clause (vii) of clause
(o) of section 2" shall be substituted.
STATEMENT
OF OBJECTS AND REASONS
According
to Section 22 of the Kerala Lok Ayukta Act 1999, every public
servant, other than a Government Servant, shall within one
year and six months after the commencement of the Act, and
thereafter before the 30 th day of June once in two years
submit to the competent authority in the prescribed form,
a statement of his assets and liabilities and those of the
members of his family. As per the said provision every public
servant including the last grade employees of Corporations.
Boards, etc, coming under the purview of the Act have to
file the statement of their assets and liabilities before
the competent authority. But as per rule 37 of the Kerala
Government Servants Conduct Rules, 1960, Last grade Government
servants are exempted from filing property statement to
Government. Government considers it necessary to exclude
the last grade employees of various organisations coming
under Kerala Lok Ayukta Act also from filing statements
of assets and liabilities to the Competent Authority as
in the case of Last Grade Government servants. Therefore
it is proposed to make suitable amendments to the Kerala
Lok Ayukta Act,1999 (8 of 1999) for the purpose

This Bill seeks to achieve the above object.
FINANCIAL
MEMORANDUM
The
Bill if enacted and brought into operation would not involve
any expenditure out of the Consolidated Fund of the State.
