Official
Language (Legislative) Commission
A
Presidential Order was issued so as to constitute the Official
Language (Legislative) Commission, on the basis of the recommendations
of the Official Language Commission and the report of the
Parliamentary Committee Constituted under Article 344 (4)
of the Constitution of India. In pursuance of the said Order
the central Official languages (Legislative) Commission
was constituted on the year 1961. Hence forth, the Ministry
of Law, Government of India was entrusted with the responsibility
of completing the necessary preparatory measures for translating
statutes. It was also entrusted with the planning and implementation
of the entire Programme relating to translation of statutes.
The Ministry was also made responsible for the preparation
of Legal Terminology and Glossary for facilitating switch
over from English to Hindi and other Indian Languages. At
that state, it was decided that the translation of Central
laws in to regional languages should be done at the Central
level in close collaboration with the appropriate agencies
at the State level. For this the central Government agreed
to bear all the expenses of translation printing and Publication
of the Central Act in regional languages.
The
above decision paved the way for the Constitution of Official
language (Legislative) Commission in the States, Accordingly,
the government of Kerala by its order issued as per G.O.
(Ms) No. 42/68/Law dated 14-6-1968 constituted the Official
Language (Legislative) Commission and suggesting modification,
if any with a view to make them suitable for adoption in
Malayalam. This was intended for scrutinizing the Malayalam
translation of the Central Acts, Rules (Issued under the
Central Acts) etc., prepared by the Central Official Language
(Legislative) Commission. It was also aimed at suggesting
modifications to make the translation appropriate to the
Malayalam language and for translating the State Acts, Ordinances
and the rules made there under into Malayalam.
Presently
the State Commission is entrusted with the task translating
and publishing the Central Acts only. In implementing its
schemes the Commission is working on the basis of the directions
of the directions issued by the Official Language wing of
the Ministry of Law, Justice and Company affairs, Government
of India. The Commission is the only institution in the
State
which has the exclusively authority to publish the central
Acts in to Malayalam.
In
view of the provisions contained in Section 2 of the
Authoritative
Texts (Central Laws) Act, 1973, the translated version of
the Central Acts published by the Commission are the Authoritative
Texts of those acts. As such those publications have the
authority of the President of India.
The
Head quarter of the Commission is at Thiruvananthapuram.
It is housed at the building with T.C. 31/183, Moonnumukku,
Pettah., Thiruvananthapuram – 695 024. The Commission is
under the administrative control of the Law secretariat

Chairperson
and Members of the Commission
The
Commission consist of one full time Chairperson and two
fill time Members. They are in the cadre of Additional secretary
to Government, Law secretariat of the Government of Kerala.
The secretary of the Commission is in the cadre of joint
secretary of Law Secretariat. The Secretary is the authority
who is responsible for the matter relating to administration
of the Commission.

The
Organizational setup of the Commission is as follows:
For
the smooth functioning of the Commission the staff of the
Commission are being deployed in the following three Wings:-

Technical
Wing:- The technical Wing consists of one Language
Expert, four Draftsmen, two Language Assistants Four
Assistants and three Confidential Assistants |

Sales
Wing:- This wing has been constituted in 1986 for
accelerating the sale of the Malayalam version of
the Central Acts Published by the Commission. Separate
Officers are not appointed in this Wing. Therefore
legal assistants from the Technical Wing have been
appointed to attend to the work of this wing. |

Administration:-
The Administration Wing Consist of one Section Officer,
two Assistants and other supporting staffs. |

Kerala
State Legal Service Authority
The
Kerala State Legal Service Authority is constituted as per
Notification No. 3115/H1/98/Law dated 25-04-98. It is a
statutory body constituted under the Legal Services Authorities
Act, 1987. The Chief Justice of High Court of Kerala is
the parton-in-Chief of the Authority. Its main functions
are to give Effect to the Policy and directions of the Central
Authority, and to Provide legal service to persons who satisfy
the criteria laid down Under the Act. It conduct Lok Adalats,
including Lok Adalats for High Court cases; It undertake
preventive and strategic legal aid Programmes and perform
such other functions as the State Authority may, in consultation
with the Central Authority, fix by regulations. The Head
quarter of the Authority is at Ernakulam.

The
office of the Advocate General of Kerala
As
per Article 165/(1) of the Constitution of India, an Advocate
General is appointed for each State. The Constitutional
duties assigned to the post are to give advice to the Government
of the State upon such legal matters, and to perform such
other duties of legal character as may from time to time
be referred or assigned to him by the Governor and to discharge
and to discharge the functions conferred on him or under
the Constitution or by any other law for the time being
in force.
In
exercise of the powers conferred by clause (2) and (3) of
Article 165 of the Constitution, the Governor had framed
the Rules Regulating the Conditions of Service, Duties,
Remuneration etc. of the Advocate General and Additional
Advocate General, Kerala issued in Notification No. ld(a).1

The
Office of the Administrator General and Official Trustee
Of Kerala
The
Administrator General is appointed by the State Government
under Section 3 of the Administrators General Act, 1963
(Central Act 45 of 1963). The Administrator General issued
Administration Certificates under the Act and realizes fees
and Commission for the purpose.
The
Official Trustee is appointed by the State Government under
Section 4 of the Official Trustee Act, 1913 (Central Act
No.2 of 1913), In exercise of the powers conferred under
Section 30 of the said Act, the Government of Kerala had
framed the Rules for Regulating the Proceedings of the Official
Trustee of Kerala issued as Notification No.ld(a) 1-3494/51/Law,
dated 8th November, 1957.

The
Kerala State Human Rights Commission
The
Kerala State Human Rights Commission was constituted on
11th December 1998, by an order of Government
of Kerala, as per Section 21 of the Protection of the Human
Rights Act, 1993. Human rights means, the rights relating
life, liberty, equality and dignity of the individual guaranteed
by the Constitution or embodies in the international covenants
and enforceable by courts in India. The Commission enquiries
all sorts of human atrocities mentioned in Section 12 of
the Protection of Human Rights Act. Separate rules are framed
for functioning of the Kerala State Human Rights Commission.
The
Head Quarters of the Kerala State Human Rights Commission
is at Thiruvananthapuram.
