District Collector is the authority for issuing licence for crackers up to 50 Kgs.Chief Controller of Explosives, Chennai is the authority empowered to issue licence for crackers above 50 Kgs.There is a prescribed form for filing the application
Procedure to obtain a licence
The application for licence for crackers below 50 Kg will be got enquired through the Tahsildar, Fire Department and Police. NOC is to be obtained from them. After satisfying that it will not be used for illegal purposes, the District Collector issues the licence. The distance between two shops should not be below 15 metres. There is provision for appeal against the order of the District Collector Land Revenue Commissioner, Thiruvananthapuram is the appellate authority. There is no prescribed form for filing appeal and there is no fee for filing the appeal. Appeal should be filed 30 days from the date of communication of the order
Documents to be produced along with the appeal
1. Appeal petition duly affixed with court fee stamp worth Rs. 10/-
2. Original or attested copy of the order appealed against
On receipt of the appeal petition a copy of the same is forwarded to the District Collector for obtaining the connected Collectorate file ad detailed report on the appeal petition. On verifying the report and records and after giving an opportunity to the appellant for being head the Commissioner, Land Revenue pass final orders
There is no provision for revision. The order of the appellate authority is final. It can be challenged only before the Hon’ble High Court of Kerala.
