SPECIAL  PENSION  SCHEME FOR PERSONS WITH DISABILITIES

Aim of the Scheme:

The aim of the scheme is to give pension to the physically handicapped and disable persons who have no source of livelihood.

Eligibility

Persons with minimum 40 % handicap whose monthly income is below Rs.250/- and income is below Rs.500/- for the family.

Mode of application:

Application for pension in Form I either imprinted or manuscript appended shall be submitted in duplicate to the head of the local bodies concerned where the applicant or the beneficiary resides continuously for not less than one year on the date of application.

Documents to be produced along with the application:

·        Application in the form prescribed in GO (P) No.11/97/SWD dated 7.4.97.

·        Medical Certificate (Disability Certificate) issued by the Medical Officer of the Primary Health Centre concerned for the Physically Handicapped.  In the case of mentally retarded Certificate from the Medical Officer not below the rank of an Assistant Surgeon in Government Service with specialization in psychiatry.

Amount of pension :

The amount of pension shall be Rs.110/- per mensem.

Sanctioning Authority

The Committee of the local bodies ( Grama Panchayat / Municipality / Municipal Corporation ) concerned shall be consider each application with the report of Ward Member and Secretary of the concerned local bodies and sanction the pension within one month.  The pension sanctioned will have effect from the first of the month in which it is sanctioned.

Appeal:

The appeal shall lie to the District Collector within 30 days from the date of receipt of the orders of the sanctioning authority.  The final orders on appeal shall be passed within one month from the date of receipt of the appeal petition.  Application or appeal under these rules are exempted from the payment of Court Fee.

Mode of disbursement:

The pension will be paid by the Secretaries of the local bodies concerned by money order without deducting the commission.

LAND  ACQUISITION

The interested parties can file objection against the Land acquisition proceedings within 30 days on receipt of the 4(a) notice to the Land Acquisition Officer.  In case the land is acquired under urgency clause there is no provision to file objection against LA Proceedings. The District Collector or the Officers specially authorized is the competent authority under the LA act to acquire land.

Under the land LA Act, acquisition can be made for any public purpose defined under the Act. The preliminary procedures for acquiring land under LA Act is the publication of 6(1) Notification under the Survey and Boundaries Act and Publication of 4(1) Notification under LA Act in two local dailies and in the Kerala Gazette, comprising the District Taluk, Village, Survey No. and approximate area of the land proposed for acquisition are the preliminary procedure of land acquisition. For fixing the land value the Land Acquisition Officer has to consider the document executed for similar and similarly situated land within a radius of 5 KM that too within a period of 3 years prior to the publication of the 4(1) notification. The District Collector shall make award within a period of three years from the date of publication of 4(1) notification. Compensation will be disbursed after passing the award. Objection with respect to inadequate compensation shall be made before the concerned Land Acquisition Officer within six weeks of the receipt of the notice from the Land Acquisition Officer under Sec. 12 or within six months from the date of award which ever shall first expire.

An individual can make a request to Government for acquiring his own property under LA Act if the balance land left after LA Proceedings remained useless to the owner for any purpose. The land acquired as per LA Act cannot be reconveyed to the owner in case the land is not utilized for the purpose acquired for. The Government can withdraw from acquisition proceedings once initiated. Government can also lease a property acquired under LA Act. Eligibility for compensation under acquisition commence from the date of 4(1) Notification.

PENSION SCHEME FOR UNMARRIED WOMEN

ABOVE 50 YEARS OF AGE

Aim of the Scheme:                    

The aim of the scheme is to give pension to the unmarried women above 50 years of age who have no source of livelihood.

Eligibility

Unmarried women above 50 years of age with annual income below Rs.6,000/- and not in receipt of any other pensions.

Mode of Application

Application for pension in Form 1 either in printed or manuscript shall be submitted in duplicate to the head of the local bodies concerned where the applicant or the beneficiary resides continuously for not less than one year on the date of application.

Documents to be produced along with the application

·  Application in the Form prescribed in GO(Ms) No.14/2001/SWD dtd. 31.03.2001.

·  Income Certificate.

·  Certificate to prove age of the applicant

·  Certificate to prove as unmarried women.

Amount of Pension

The amount of pension shall be Rs.110/- pe3r mensem.

Sanctioning Authority:

The Committee of the local bodies concerned shall be the pension sanctioning authority.  The Committee shall consider each application with the report of the  Ward Member and Secretary of the Local Bodies and sanction the pension within one month.  The pension sanctioned will have effected from the first of the month in which it is sanctioned.

Appeal

The appeal shall lie to the District Collector within 30 days.  The final orders on appeal shall be passed within one month from the date of receipt of the appeal direction.  Application or appeal under these are exempted from the payment of Court Fee.
